Federal Judge Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was detained in immigration detention.
In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
